Terms and conditions of use for TIME IS PRECIOUS and e-booking

Duties of the agency

Package travel agreements shall be brokered for HLC with consideration for the duties of care of a prudent businessperson.

Furthermore:

1. in order to make a booking using the e-booking system on the TIP portal, the employee’s superior or agency owner must first authorise him/her to use the portal. The agency undertakes to immediately inform HLC in writing if an employee who is authorised to use the HLC booking system leaves the agency. Furthermore, the agency undertakes to inform HLC of changes to e-mail addresses, especially if the address of the agency owner or person responsible should change. All authorisations shall be stored on the TIME IS PRECIOUS system and, on request, can be presented.

2. to immediately forward the HLC booking confirmation and all other travel documents to the customer;

3. to adhere to the prices published by the tour operator;

4. to issue the guarantee certificate in the sense of section 651 k, paragraph 3, of the German Civil Code (BGB);

5. to issue the travel documents to the customer after full payment of the cruise price;

6. to immediately inform HLC of any notices of cancellation and customer complaints it receives;

7. the agency undertakes to adhere to the provisions of the German Federal Data Protection Act (BDSG) and, in particular, to ensure that customers’ addresses are protected;

8. the agency may not conclude any agreements, provide any information or make any assurances that would change the agreed content of the travel agreement, go beyond services to which HLC has committed in the travel agreement, or conflict with the advertised cruise.

9. in order to see revenue figures on the TIP portal, the employee’s superior or agency owner must first authorise him/her to use the portal. The agency undertakes to immediately inform HLC in writing if an employee who is authorised to see the revenue figures  leaves the agency. Furthermore, the agency undertakes to inform HLC of changes to e-mail addresses, especially if the address of the agency owner or person responsible should change. All authorisations shall be stored on the TIME IS PRECIOUS system and, on request, can be presented.

 

Liability of the agency

In cases of culpable damage, especially due to improper booking and payment processing or omitted or delayed information, the agency shall be liable for the damage suffered by HLC.

 

Business and operating secrets

Both parties are obliged to treat their business transactions as confidential, even after the end of their contractual agreement, in so far as this would not conflict with the professional ethics of a prudent businessperson under the general circumstances.
